Terms of Submission to Optica Open
By completing the submission process, you are agreeing to the Terms of Submission to Optica Open. The submission is referred to as the “Work” and the submitting author is referred to as the “Submitter” in the Terms of Submission, which are as follows:
REPRESENTATIONS AND WARRANTIES.
The Submitter makes the following representations and warranties:
- The Submitter is an original author of the Work.
- If the Work was created by multiple authors, all authors have consented to submission of the Work to Optica Open.
- The Work is original to the authors.
- Any scientific knowledge contained in the Work, and information provided during the submission process, is true and accurate.
- The information about the Submitter’s identity, academic or research position or qualifications, and academic or business affiliations are accurate, and likewise for all other authors.
- The use of any third-party copyrighted or unpublished material contained in the Work is consistent with scholarly and academic standards for obtaining permission and providing attribution of sources, appropriate release forms have been obtained from any individual(s) whose likenesses are represented, and the Submitter will deliver such consent and/or release forms to Optica Publishing Group upon request.
- Nothing in the Work submitted to Optica Open contains any software viruses or computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment.
- The Work is not subject to any agreement, license or other known or likely future claim or dispute that could interfere with the rights granted herein.
- The distribution of the Work by Optica Open will not violate any rights of any person or entity, including without limitation any rights of copyright, patent, trade secret, privacy, or any other rights, and it contains no defamatory, obscene, or other unlawful matter.
- The Submitter has the full power, with authorization from all authors, if applicable, to agree to these terms and make the grants contained herein.
The Submitter understands and accepts that:
- Publication of the Work in Optica Open does not indicate, imply or promise that the Work has or will be accepted for formal peer review and/or publication of the Work by Optica Publishing Group or any other publisher in any journal.
- Optica Publishing Group reserves the right, for any reason, to reject the submitted Work and refrain from posting it on Optica Open and / or to remove the Work from Optica Open, at any time. The Submitter may also request the removal of the Work from Optica Open by sending an email to opticaopen-questions@optica.org, which sets forth the basis of the request. Optica Publishing group will review requests within thirty days. Content will only be removed under extraordinary circumstances.
- Retraction notices may be subsequently posted with respect to submitted Work at any time, as requested by the Submitter, the Submitter’s employer, or Optica Publishing Group’s Editorial Ethics Subcommittee. If such notices are proposed by any party other than the Submitter, the Submitter will be provided an opportunity to review and to comment with respect to the subject matter of the proposed retraction. Ultimately, such editorial decisions will be at the sole discretion of Optica Publishing Group.
- Optica Publishing Group reserves the right to, for any reason, edit or remove any metadata (information about a submission) submitted in relation to the Work. The Submitter will receive notifications of any changes to the submitted metadata in relation to the Work.
GRANT OF LICENSE TO OPTICA PUBLISHING GROUP
The Submitter grants to Optica Publishing Group upon submission of the Work a non-exclusive, perpetual, worldwide and royalty-free License to include the Work in Optica Open and permit users to access, view, and make other uses of the work in a manner consistent with the services and objectives of Optica Open. This License includes without limitation the right for Optica Publishing Group to reproduce (e.g., upload, backup, archive, preserve, and post online), distribute (e.g., allow access), make available, edit, and prepare versions of the Work (e.g., abstracts, and metadata or text files, formats to support accessibility, machine-readable formats) in analog, digital, or other formats as Optica Publishing Group may deem appropriate.
This is not a grant of exclusive rights or a transfer of the copyright. The authors retain their copyright and may enter into publication agreements or other arrangements, so long as they do not conflict with the ability of Optica Publishing Group to exercise its rights under the License. Optica Publishing Group has no obligation to protect or enforce any copyright in the Work, and Optica Publishing Group has no obligation to respond to any permission requests or other inquiries regarding the copyright in or other uses of the Work.
Submitter, on behalf of all authors, grants Optica Publishing Group permission to use the name, image, likeness and biographical information of the authors in connection with promoting or advertising the Work and any adaptation thereof, in any and all media, as Optica Publishing Group may deem appropriate in its sole reasonable discretion. Authors shall have no right of approval and no claim to any compensation with regard to Optica Publishing Group’s use of their name, image, likeness and biographical information in conjunction with promoting or advertising the Work.
WAIVER OF RIGHTS, LIMITATION OF LIABILITY AND INDEMNIFICATION
The Submitter forever waives, discharges and releases Optica Publishing Group, its affiliates, directors, officers, employees, and agents from the following claims on behalf of all authors:
- Any claims against Optica Publishing Group, its affiliates, or any director, officer, employee, or agent thereof, based upon the use of the Work by Optica Publishing Group consistent with the License.
- Any claims against Optica Publishing Group, its affiliates, or any director, officer, employee, or agent thereof, based upon actions taken by any such party with respect to the Work, including without limitation decisions to include the Work in, or exclude the Work from the repository; editorial decisions or changes affecting the Work, including the identification of Submitters and their affiliations or titles; the classification or characterization of the Work; the content of any metadata; the availability or lack of availability of the Work to researchers or other users of Optica Open, including any decision to include the Work initially or remove or disable access.
- Any claims related to the integrity of the Work under Moral Rights principles.
- Any claims against Optica Publishing Group, its affiliates, or any director, officer, employee, or agent thereof based upon any loss of content or disclosure of information provided in connection with a submission.
The authors shall indemnify, defend, and hold harmless Optica Publishing Group, its affiliates and their directors, officers, employees and agents from any loss, damage, liability or claim arising out of or related to: (a) any breach of any representations or warranties herein; (b) any failure by Submitter to perform any of Submitter’s obligations herein; and (c) any use of the Work as anticipated in the License and terms of submittal.
LICENSE FOR REUSE
The Submitter must select one of the following licensing options, which determine whether and how the content can be reused by others:
- Optica Publishing Group Non-Exclusive License gives Optica Publishing Group rights to distribute the work and allows users to read, download, copy, distribute, print, search, or link to the full text of the work, or use it for any other lawful purpose, without asking prior permission from the author(s).
- CC BY 4.0 (Attribution only) allows others to copy, reuse, adapt, and build upon the work, including for commercial purposes, as long as the content is attributed to you.
- CC BY-SA 4.0 (Attribution-ShareAlike) allows others to copy, reuse, adapt, and build upon the work, including for commercial purposes, as long as the content is attributed to you and the adapted work is distributed under the same license as the original.
- CC BY-NC-SA 4.0 (Attribution-Noncommercial-ShareAlike) allows others to copy, reuse, adapt, and build upon the work for non-commercial purposes, as long as the content is attributed to you and the adapted work is distributed under the same license as the original.
